These Terms of Service (the “Terms”) govern your access to and use of the website located at simplybuildable.com (the “Site”) and the tools and services made available on the Site, including the build cost calculator, the renovation cost calculator, the construction loan calculator, the consultation booking flow, and the agent page (collectively with the Site, the “Services”), operated by Buildable, Inc., a California corporation (“Buildable,” “we,” “us,” or “our”).
Please read these Terms carefully. They include important provisions affecting your legal rights, including a mandatory pre-suit notice and good-faith negotiation period (Section 16), a class action waiver subject to certain exceptions (Section 16.3), a jury trial waiver (Section 16.4), a limitation of liability (Section 14), and accessibility commitments and reporting procedures (Section 12). By accessing or using the Services, you agree to these Terms. If you do not agree, do not access or use the Services.
1. Who These Terms Apply To
These Terms apply to anyone who accesses or uses the Services, including visitors, prospective clients, real estate agents, and anyone using any of the calculators or booking a consultation. You must be at least 18 years old and able to form a legally binding contract to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
For purposes of these Terms, a “User” means any person who accesses or uses the Site or Services. A “Customer” or “Client” of Buildable means a person who has entered into a signed Services Agreement with Buildable for construction, design, or other professional services. Use of the Site, submission of an inquiry, participation in a free consultation, or any other interaction short of a signed Services Agreement does not by itself make you a Customer or Client of Buildable. No professional, contractual, or fiduciary relationship is created between you and Buildable except as expressly set forth in a signed Services Agreement.
2. What These Terms Don’t Cover
These Terms govern your use of the Site and the Services. They do not govern any construction services, design services, feasibility studies, project management, renovation services, or other professional services that Buildable may provide to you under a separate written agreement (a “Services Agreement”). If you and Buildable enter into a Services Agreement, that agreement will govern those services and will control over these Terms in the event of any conflict on matters covered by the Services Agreement.
Nothing on the Site, including any communication through consultation forms, the calculators, the booking flow, blog posts, or other content, creates a contract for construction or any other professional services. A binding agreement for any work by Buildable requires a signed written Services Agreement.
3. Buildable’s Licensing
Buildable holds California Contractor’s License #1080271. Information about Buildable’s license can be verified through the California Contractors State License Board at cslb.ca.gov.
Buildable is not a lender, mortgage broker, real estate broker, financial advisor, attorney, or accountant. Nothing on the Site constitutes legal, financial, tax, real estate, or lending advice. Consult appropriate licensed professionals for advice specific to your situation.
4. Use of the Services
4.1 Permitted Use
You may use the Services for personal, non-commercial purposes related to evaluating Buildable’s services, researching custom home building or renovation, or communicating with Buildable about a potential project.
4.2 Prohibited Use
You agree not to:
Use the Services in any way that violates any applicable law or regulation
Copy or reproduce substantial portions of content from the Site for republication or commercial use that competes with Buildable
Interfere with, disrupt, or attempt to gain unauthorized access to the Services, including by evading rate limits or bot detection
Use the Services to transmit viruses, malware, or other harmful code
Impersonate any person or entity
Use the Services to send unsolicited communications
Damage, disable, or overburden the Site
Harvest personal information about other Users
We reserve the right to terminate your access to the Services for any reason, including violation of these Terms.
4.3 Permitted Access by Search Engines and Discovery Tools
Buildable welcomes search engines, social media platforms, AI-powered discovery tools, news aggregators, and similar services that help users find Buildable, provided they: (a) respect our robots.txt file and any other published technical access controls, (b) do not overload the Site, (c) include attribution to Buildable with a working link back to the source page when displaying our content, and (d) do not harvest user-submitted information. Buildable reserves the right to modify these permissions at any time, including through updates to our robots.txt file.
4.4 AI Training
You may not use content from the Site to train, fine-tune, or develop any artificial intelligence model, machine learning system, or similar technology without Buildable’s prior written permission. This restriction does not prohibit AI-powered search or discovery tools that surface information about Buildable in response to user queries, provided that such tools comply with Section 4.3 (including the attribution and link-back conditions).
4.5 Unauthorized Litigation-Driven Access
Buildable monitors access patterns to the Site. Access to the Site for purposes of generating, supporting, or investigating a legal claim against Buildable, including by automated tools, professional testers, or persons acting under the direction of or for compensation from counsel preparing or threatening litigation, exceeds the scope of any permission granted under these Terms and constitutes unauthorized access. Such unauthorized access may give rise to claims under the federal Computer Fraud and Abuse Act (18 U.S.C. § 1030), the California Comprehensive Computer Data Access and Fraud Act (Cal. Penal Code § 502), and breach of these Terms, and may subject the unauthorized user to liability for statutory damages, actual damages, attorneys’ fees, and injunctive relief as provided by applicable law. Buildable reserves all rights and remedies in connection with such unauthorized access.
5. Calculators: Important Disclaimer
The Site includes several calculators, including the build cost calculator, the renovation cost calculator, and the construction loan calculator (each, a “Calculator,” and together, the “Calculators”).
The Calculators provide rough estimates for general informational purposes only. The output of any Calculator is not a quote, bid, proposal, offer to perform construction services at any price, offer to lend, or commitment of any kind. Calculator output does not create any contract, obligation, or commitment by Buildable.
You acknowledge and agree that:
Calculator output is based on general assumptions and limited inputs and does not account for the specific conditions of any particular property, project, financial situation, or borrower
Actual construction costs, renovation costs, loan terms, and interest rates vary significantly based on factors that the Calculators cannot evaluate, including but not limited to soil conditions, slope, access, utility availability, zoning, permitting requirements, design complexity, finish selections, market conditions, labor availability, material costs, lender underwriting, your credit history, your income, and your debts
Any estimate produced by a Calculator may differ materially from actual costs, prices, or loan terms
Pricing for any actual project will be determined only through a written Services Agreement following site evaluation, design, and proper estimation
Loan terms and qualifications can only be determined by a licensed lender after a complete application
Buildable makes no representation, warranty, or guarantee that any project can be completed at or near the price suggested by any Calculator, or that any borrower can obtain financing at the rates or terms suggested by the construction loan calculator
You will not rely on Calculator output for any financial, investment, lending, real estate purchase, or other decision
5.1 Construction Loan Calculator: Additional Disclaimer
Buildable is not a lender, mortgage broker, or financial advisor. The construction loan calculator does not constitute an offer or commitment to lend, an application for credit, or financial advice. Output from the construction loan calculator is not a Truth in Lending disclosure under federal law (15 U.S.C. § 1601 et seq.) or under California’s Financing Law.
You should consult a licensed lender or mortgage professional for actual loan options, rates, and terms. Buildable does not arrange financing, originate loans, or receive compensation from lenders for referrals.
By using any Calculator, you waive any claim against Buildable based on differences between Calculator output and actual project costs, pricing, quotes, or loan terms. If you want a real estimate for an actual property or project, contact us to schedule a consultation.
6. Consultations, Booking, and Communications
The Services include a consultation booking flow that allows you to schedule a free consultation with Buildable. Booking is handled through Calendly, which collects information needed to book and confirm the appointment, including your name, email, phone number, and the date and time you select. Use of the Calendly booking flow is also subject to Calendly’s terms of service and privacy policy.
Consultations may take place in person, by phone, or by video. Video consultations are conducted using Zoom and are subject to Zoom’s terms of service and privacy policy. We do not record consultations without your explicit consent.
6.1 Email, Phone, and Text Message Communications
When you submit a form, request a consultation, or otherwise provide your contact information through the Services, you expressly consent to receive communications from Buildable by email, phone call, and text message (SMS) at the contact information you provide. These communications may include:
Responses to your inquiry
Estimates, project information, and follow-up communications
Appointment confirmations, reminders, and rescheduling notices
Marketing communications about Buildable’s services
Educational content and ongoing nurture communications
Telephone Consumer Protection Act (TCPA) Consent. By providing your phone number and submitting a form on the Site, you give your prior express written consent for Buildable, and any third parties acting on Buildable’s behalf, to contact you at that number, including by automatic telephone dialing system, artificial or prerecorded voice, and text message. This consent is not a condition of any purchase or Services Agreement. Standard message and data rates may apply to text messages.
How to opt out of marketing communications:
Email: Click the unsubscribe link in any marketing email
Text messages: Reply STOP to any marketing text message. You may also reply HELP for help.
Phone calls: Tell us during any call, or email nick@simplybuildable.com to be removed from our marketing call list
Opting out of marketing communications will not stop transactional communications related to a specific inquiry, estimate, or appointment you have requested.
6.2 No Professional Relationship Created
Submitting a consultation request, scheduling a consultation, sending us an email, or otherwise communicating with us through the Services does not create a contractual relationship between you and Buildable, an attorney-client relationship, a builder-client relationship, or any other professional relationship. No professional relationship is formed until a Services Agreement is signed by both parties.
Any information you provide to Buildable through the Services may be used by Buildable to evaluate your potential project, communicate with you, and improve the Services, in accordance with our Privacy Policy.
7. Real Estate Agents
The Site includes a page directed at real estate agents and brokers. If you contact Buildable in your capacity as a real estate agent, you represent that you are acting in compliance with all applicable real estate licensing laws, fiduciary obligations to your clients, and brokerage policies. Any referral, co-marketing, or working relationship between Buildable and any real estate agent or brokerage requires a separate written agreement. Nothing on the Site or in any communication through the Services creates such a relationship by itself.
8. Content on the Site
8.1 Buildable Content and Third-Party Content
The Site contains content created by or for Buildable, including original text, articles, blog posts, photographs of projects, graphics, the Buildable logo, and the design and arrangement of the Site (“Buildable Content”). Buildable Content is owned by Buildable or its licensors and is protected by copyright, trademark, and other intellectual property laws.
The Site may also include third-party content, including without limitation stock photographs, embedded media, content provided by clients or vendors, and content licensed from third parties (“Third-Party Content”). Third-Party Content remains the property of its respective owners and is used on the Site under license, with permission, or as otherwise permitted by applicable law. Buildable makes no claim of ownership over Third-Party Content.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view content on the Site for your personal, non-commercial use in evaluating Buildable’s services. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, or sell any content on the Site without the prior written consent of the appropriate rights holder, whether that is Buildable or a third party.
If you believe any content on the Site infringes your copyright or other intellectual property rights, please follow the procedures described in Section 9 (Copyright Infringement Claims).
8.2 Trademarks
“Buildable,” the Buildable logo, and any other Buildable marks displayed on the Site are trademarks of Buildable, Inc. You may not use these marks without our prior written permission.
8.3 Informational Purpose
Articles, blog posts, knowledge center content, and other informational content on the Site are provided for general informational purposes only. This content does not constitute professional advice for your specific situation. Construction costs, regulations, codes, permitting requirements, lending rates, and market conditions vary by location and change over time. Do not rely on Site content as a substitute for consultation with a licensed professional regarding your specific project, property, financing, or circumstances.
9. Copyright Infringement Claims (DMCA)
Buildable respects the intellectual property rights of others and expects users of the Services to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”).
9.1 Reporting Copyright Infringement
If you believe that material on the Site infringes your copyright, you may submit a notice to Buildable’s designated DMCA agent. To be effective, your notice must include the following:
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
Identification of the copyrighted work claimed to have been infringed
Identification of the material that is claimed to be infringing, with enough detail for us to locate it on the Site (URL, page title, or screenshot)
Your contact information, including address, telephone number, and email address
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf

9.2 Counter-Notice
If you believe that material you posted to the Site was removed in error, you may submit a counter-notice to the DMCA agent at the same address. To be effective, your counter-notice must include:
Your physical or electronic signature
Identification of the material that has been removed and its previous location on the Site
A statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification
Your name, address, and telephone number
A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or, if your address is outside the United States, the federal court for the Southern District of California, and that you will accept service of process from the person who provided the original notice or their agent
9.3 Repeat Infringers
Buildable will, in appropriate circumstances, terminate the access of users who are repeat infringers of copyright.
9.4 False Claims
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Do not submit false notices.
10. Third-Party Links and Content
The Site may contain links to third-party websites, services, or content. These links are provided for convenience only. Buildable does not endorse, control, or assume responsibility for any third-party sites or content. Your use of any third-party site is at your own risk and subject to the terms and policies of that third party.
11. Privacy
Your use of the Services is also governed by our Privacy Policy, available at https://privacy.cptn.co/privacy-policy/ea79164e-e8ed-459e-8876-961ce570abb0#introduction, which is incorporated into these Terms by reference. By using the Services, you consent to the data practices described in our Privacy Policy.
12. Accessibility
Buildable is committed to making the Site accessible to all users, including individuals with disabilities, and is working toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. Buildable has engaged accessibility professionals to audit the Site and is actively remediating identified issues.
The Site is built on a third-party website platform (currently Squarespace). Buildable’s accessibility efforts focus on the content, configuration, and design choices within Buildable’s control. Where accessibility issues arise from the underlying platform, Buildable will work with the platform provider, seek workarounds, or provide alternative means of access as described below.

Buildable will acknowledge accessibility reports within five (5) business days and will work in good faith to address the concern through reasonable accommodations or remediation.
If you are unable to access content or complete a transaction on the Site due to an accessibility barrier, Buildable will work with you to provide the information, complete the transaction, or deliver the service through an alternative accessible means, including by telephone, email, mail, or in-person assistance, at no additional cost to you.

13. Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, BUILDABLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Buildable does not warrant that:
The Services will be uninterrupted, secure, or error-free
Any information on the Site, including output from any Calculator, is accurate, complete, current, or reliable
Any defects in the Services will be corrected
The Services or any associated servers are free of viruses or other harmful components
Without limiting the foregoing, Buildable specifically disclaims any warranty that any Calculator or any other tool, content, or information on the Site will produce results suitable for any specific property, project, financing arrangement, financial decision, or other purpose. Buildable also makes no warranty as to the ownership, licensing status, or non-infringement of any Third-Party Content (as defined in Section 8.1) that may appear on the Site, and any claim of infringement should be directed through the procedures in Section 9.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent your jurisdiction prohibits any disclaimer in this section, that disclaimer is limited to the maximum extent permitted by applicable law.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUILDABLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING ANY RELIANCE ON CALCULATOR OUTPUT OR ANY CONTENT ON THE SITE, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), AND EVEN IF BUILDABLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BUILDABLE’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED ONE HUNDRED DOLLARS ($100).
This limitation does not apply to liability that cannot be limited under applicable law (for example, claims arising from gross negligence, willful misconduct, or fraud). Some jurisdictions do not allow certain limitations of liability. To the extent any limitation in this section is prohibited, it is limited to the maximum extent permitted by applicable law.
This limitation of liability does not apply to any Services Agreement between you and Buildable for actual construction or professional services. Liability under any such Services Agreement is governed by that agreement.
15. Indemnification
You agree to indemnify, defend, and hold harmless Buildable and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
Your use of the Services
Your violation of these Terms
Your violation of any rights of any third party
Any content you submit, post, or transmit through the Services
Buildable reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.
16. Dispute Resolution
16.1 Pre-Suit Notice and Good-Faith Negotiation
Before initiating any lawsuit against Buildable arising out of or related to these Terms or the Services, you must first send Buildable a written Notice of Dispute by mail to Buildable, Inc., 1405 Ferrara Ct, Escondido, CA 92025, with a copy by email to nick@simplybuildable.com.
To be effective, the Notice of Dispute must include:
Your name, mailing address, telephone number, and email address
A specific description of the conduct or omission you believe gives rise to the dispute, including relevant dates, URLs, and circumstances
The specific relief you seek, including any dollar amount of damages with supporting calculation
Documentary evidence reasonably available to you supporting the claim
Your personal signature
The parties agree to make good-faith efforts to resolve the dispute informally for thirty (30) days following Buildable’s receipt of an effective Notice of Dispute. No lawsuit may be filed before this thirty-day period has elapsed. A Notice of Dispute that does not include the required elements is not effective and does not start the thirty-day period.
16.2 California-Law Claims: Additional Notice Requirements
If your claim is brought under California law where California residency or California presence is an element of the claim — including without limitation claims under the California Invasion of Privacy Act (Cal. Penal Code §§ 630 et seq.), the California Consumer Privacy Act, the California Privacy Rights Act, the Unruh Civil Rights Act, or any similar statute — the Notice of Dispute must additionally include:
Documentation reasonably establishing that you were a California resident at the time of the conduct giving rise to the claim. Acceptable documentation may include a copy of a California driver’s license or state-issued identification, a California voter registration record, a recent utility bill at a California address, a lease or mortgage document for a California residence, or a sworn declaration attesting under penalty of perjury to California residency with your California address at the relevant time.
The IP address from which you accessed the Site at the time of the conduct giving rise to the claim, if known to you, together with any documentary evidence reasonably available to you supporting that the access occurred from California. Where IP records are not reasonably available, a sworn declaration attesting under penalty of perjury that you were physically present in California at the time of the access satisfies this requirement.
16.3 Class Action Waiver
Neither you nor Buildable may bring a claim as a plaintiff or class member in any purported class action or representative proceeding. Buildable retains the right, at its sole option, to negotiate or resolve multiple individual claims in a coordinated or bundled manner where doing so promotes efficient resolution. Nothing in this provision prohibits Buildable from agreeing to bundled or coordinated resolution if Buildable so elects.
16.4 Jury Trial Waiver
YOU AND BUILDABLE EACH KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, WHETHER SOUNDING IN CONTRACT, TORT, STATUTE, OR OTHERWISE.
17. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. For any dispute arising out of or related to these Terms or the Services that is not resolved through the procedures in Section 16, you and Buildable agree to the exclusive jurisdiction of the state and federal courts located in San Diego County, California, and waive any objection to venue in those courts including any objection based on inconvenient forum.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Site and update the “Last Updated” date at the top. Material changes will be effective 30 days after posting, except that changes addressing new functionality or required by law may be effective immediately. Your continued use of the Services after the effective date of updated Terms constitutes your acceptance of the updated Terms.
19. Termination
We may terminate or suspend your access to the Services at any time, with or without cause, with or without notice. Sections that by their nature should survive termination shall survive any termination of these Terms or cessation of your use of the Services, including without limitation Sections 5 (Calculator Disclaimer), 8 (Content), 9 (DMCA), 12 (Accessibility), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), 16 (Dispute Resolution), 17 (Governing Law and Venue), and 20 (Miscellaneous).
20. Miscellaneous
20.1 Entire Agreement
These Terms, together with our Privacy Policy and any Services Agreement between you and Buildable, constitute the entire agreement between you and Buildable regarding the Services and supersede any prior agreements.
20.2 Severability and Reformation
If any provision of these Terms is found to be unenforceable in whole or in part, that provision shall be enforced to the maximum extent permitted by law as if rewritten by a court of competent jurisdiction to achieve the parties’ intent while remaining enforceable. If a court declines to reform the provision, it shall be severed and the remaining provisions of these Terms shall continue in full force and effect. The parties intend that the enforceable provisions of these Terms be given the maximum scope of enforceability that is consistent with applicable law.
20.3 No Waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
20.4 Assignment
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms without restriction, including to any affiliate or in connection with a merger, acquisition, or sale of assets.
20.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
20.6 Headings
Section headings are for reference only and do not affect interpretation.
20.7 Force Majeure
Buildable is not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, or internet or utility outages.
